How to change the temporary protection country from Poland to Slovakia

How to change the temporary protection country from Poland to Slovakia

In short

Temporary protection works only in one EU country. As soon as Slovakia registers your dočasné útočisko (temporary asylum), the Polish UKR status disappears automatically — article 11 paragraph 4 of the special law does this without your application. Registration is in person at the foreigners police department, only by prior appointment, on Tuesdays and Thursdays from 7:30 to 13:30; with a foreign passport, status is granted the same day, without a document — up to 30 days. The risk is the gap between statuses: 30 days outside Poland already removes UKR status.

The most expensive mistake when moving from Poland is trying to "just in case" keep both statuses. Temporary protection works only in one EU country. As soon as Slovakia registers your dočasné útočisko (temporary asylum), the Polish UKR status disappears by itself — by law, without your application and without a warning letter.

The procedure only becomes simpler: you do not need to "close" anything in Poland before leaving. You need to calculate something else — the gap between the two statuses. This is where people get confused.

Can you have temporary protection in Poland and Slovakia at the same time?

No. One person — one temporary protection — one EU country. This is how the directive itself is designed, which all 27 countries follow.

Article 11 of the Directive 2001/55/EC obliges the state to take back a person under temporary protection if they are on the territory of another member state without permission. The directive does not allow two parallel statuses in principle — it assumes you belong to one country.

The official transfer is described but looks different than most imagine. Article 26 calls it a transfer: states agree between themselves with your consent, then the exit country's permission ends, and the new country grants protection. This is a procedure between governments, not a service you apply for in a queue.

States can see double registration. In May 2022, the European Commission launched a real-time data exchange platform about registered persons — the declared goal directly includes "double or multiple registrations." Personal data travels through the protected DubliNet channel. At that time, the Commission acknowledged that working only through national databases limits the ability to track a person using rights in two countries. Relying on this loophole is a bad bet: the loophole is closing, and the status is lost immediately in both places.

What will happen to the Polish UKR status after registration in Slovakia?

It will disappear automatically on the day you receive Slovak protection. You do not need to write a refusal application — Polish law does this for you.

The norm is direct. The special law on assistance to Ukrainian citizens, article 11 paragraph 4: obtaining temporary protection in an EU country other than Poland deprives a Ukrainian citizen of the right to stay under article 2 paragraph 1. The Polish Border Guard also explains the UKR status this way: the right is not canceled by a separate decision; it expires by itself. You will not receive any notification.

The official list of grounds for losing UKR status is broader. You lose it if you leave Poland for more than 30 days; receive a residence permit, refugee status, additional protection, or humanitarian stay; apply for international protection in Poland; receive temporary protection in another EU country; acquire citizenship of Poland or another EU country.

The 30-day rule works independently of Slovakia. If you leave and do not return within a month, the UKR status disappears, even if you have not applied for anything in Slovakia yet.

Another date easy to miss is August 31, 2026. It does not concern everyone and is often confused.

If you showed a foreign passport when getting PESEL, you do not need to do anything; the UKR status will be extended automatically. If you got PESEL only by declaring your identity, without any document, you must bring a passport to any urząd gminy (municipal office) by August 31, 2026, otherwise from September 1 both PESEL UKR and legal stay disappear. The third group — those who got PESEL by the Pole's Card, another photo ID, or birth certificate — have 60 days from the new passport issuance, and the missed temporary protection deadline does not take away their status.

Groups are easy to confuse, and voivodeship offices describe them with varying completeness — some pages mention only the first two, which causes two opposite answers online about consequences. If you do not know your group, ask the gmina that registered you, preferably in writing.

There is no separate procedure to "refuse temporary protection in Poland" in official materials — neither paper nor online. If someone promises you such a service, it is not the Polish state. Ask about your specific case at Urząd do Spraw Cudzoziemców.

How to register temporary protection in Slovakia step by step

The application is submitted in person at the cudzinecká polícia (foreigners police) department, only by prior appointment. With a foreign passport, the status is granted the same day.

The general mechanics — hlásenie pobytu (residence notification) within the first three working days, reception hours, fee for the plastic card, and 90 days to apply for it — are described in a separate analysis about temporary protection and the status of a recognized person. Here we focus on what concerns the transition from Poland:

  1. Book an appointment in the Ministry of Interior system, preferably before leaving Poland. Without a booking, the application will not be accepted — you will be turned away at the entrance. This is the narrowest point of the whole procedure, and we analyzed it separately: how to catch an appointment.

  2. Fill out the electronic pre-registration form — then your data will already be with the police, and the visit will be faster. The form and service description are on the Slovak Ministry of Interior portal.

  3. Bring a document proving identity and citizenship: foreign passport, identity document, or driver's license together with a birth certificate. With it, the status is granted immediately; without it, the decision takes up to 30 days — and 30 days outside Poland is exactly the period after which UKR status is removed.

  4. If you changed residence — go to the city office, not the police. The municipality changes the address in the temporary asylum document.

A legal representative submits the application for a minor child, and the child must be present at submission. If you do not qualify for temporary protection — for example, you already have Slovak temporary or permanent residence — see other grounds for stay.

A fresh complication has appeared for men of conscription age. Article 2 of the EU Council Implementing Decision 2026/1912 applies from July 31, 2026, and grants temporary protection to new applicants only if they have fulfilled military service in Ukraine. The exception in the decision text is tied to a specific country: it covers those who had protection in the same country as of July 30, 2026, and continuously keep it there. An application in Slovakia after moving is a new application in a new country, and formally the condition applies. How Slovak police will interpret this in practice is unknown in advance: ask the foreigners police department or the IOM Migration Information Center before booking an appointment and deregistering.

What does the status give in Poland and what in Slovakia

Basic rights in both countries are similar. The difference is in details, and they decide when you will be left without money or without a doctor.

What exactly

Poland, UKR status

Slovakia, dočasné útočisko

Work

without permit; employer notifies powiatowy urząd pracy (district labor office) within 7 days, employer pays fine for non-notification

without permit; employer submits informačná karta within 7 working days; from 07/15/2024 entrepreneurship allowed

Healthcare

upon payment of contributions, as for Poles; without this — children under 18, pregnant women, residents of accommodation centers

state health insurance: adults from 09/01/2023, children under 18 years and 364 days from 01/01/2023

Housing

free accommodation centers only for vulnerable groups and only until 03/04/2027; others from 06/30/2026 — commercial

príspevok za ubytovanie (housing allowance) is received not by you but by the landlord: €5 per night in private housing, €6 in dormitory, and from 03/01/2025 — maximum 60 days from first status grant

Status date

until March 4, 2027

until March 4, 2027

Absence over 30 days

status disappears automatically

travel, including trips to Ukraine, does not cancel status

Protection in another EU country

deprives right to stay

terminates Slovak status

The last row is a mirror: the rule works both ways. If you get protection somewhere else later, you lose Slovak status.

Can you work immediately and what about healthcare?

You can work from the day the status is granted and without any additional permits. Healthcare is more complicated: full insurance starts with the status, not the application.

The employer notifies the employment center with the informačná karta form within seven working days, attaching a copy of the temporary asylum document and a copy of the contract. You can work under an employment contract or a dohoda (contract outside employment relations). Where to look — job vacancies in Slovakia.

While the application is being processed, you have the right to urgent medical care. This is enough to be accepted in emergencies but insufficient for planned doctor visits. Adults with granted status get state health insurance with preventive checkups and medical procedures; children from birth to 18 years and 364 days have the same coverage since January 1, 2023. How this works in practice is explained in the analysis of the Slovak healthcare system.

Simple arithmetic follows. Arrived with a valid passport — almost no insurance gap, status granted on the visit day. Arrived without a passport — plan for up to 30 days without planned healthcare.

What about children and school?

A child can go to kindergarten or school right after submitting the application. No need to wait for a decision.

Go directly to the chosen institution. They will assess knowledge and Slovak language skills and place the child in the appropriate class; Slovak will be taught additionally. We described the enrollment process step by step in the parents' guide.

What not to do to avoid losing all status

The most dangerous scenario is a pause between statuses. Thirty days outside Poland already removes UKR status, and Slovak status is not yet granted.

  1. Do not delay registration after leaving. Book an appointment before moving, not after.

  2. Do not submit an asylum application "at the same time." Asylum is a separate procedure, and submitting an asylum application stops temporary asylum in Slovakia.

  3. Do not expect Polish benefits to follow you. Rights under the special law disappear with the UKR status, not gradually.

  4. Do not leave Polish PESEL unconfirmed if it was issued without a passport and your plans may still change: the August 31, 2026 deadline applies regardless of your intentions.

And a mirrored advice for those moving the other way: before leaving Slovakia, read what closing status here gives — there are different deadlines.

What if you move not from Poland but from Czechia or Germany?

The mechanics are the same: the one-country rule is common for the entire EU. Only national procedures for losing status differ, and you should check them in the exit country.

One case reached the EU Court. In case C-753/23, decision from February 27, 2025, a Ukrainian citizen applied for temporary protection in Germany, and two months later in Czechia; the Czech ministry refused because the application was already in another state. The Court ruled: refusal only because a person applied but has not yet received permission in another country is not allowed. Second — such refusal can be appealed in court.

The limit of this decision should be seen honestly. The Court answered specifically about the case "applied but not yet received." It did not resolve the situation "already received and wants a second," so here remains a gray zone, and ask about your case directly at the migration department.

Do not confuse two different stories: moving to Slovakia is not the same as working abroad with Slovak documents, which has its own rules.

Where to start today?

Open the booking system and check the nearest Tuesday and Thursday — count everything else from the appointment date. Keep two dates separately in your calendar: August 31, 2026, if your Polish PESEL was issued without a passport, and March 4, 2027, until which temporary protection currently applies in both countries. The next year was agreed on July 15, 2026, and on July 30 the EU Council adopted Implementing Decision 2026/1912 and extended protection until March 4, 2028. The extension applies only from March 5, 2027, and Slovakia has not officially announced this date yet — so the documents you hold still show 2027.

Frequently asked questions

How many days can you be outside Poland without losing UKR status?+
Thirty. It is written in the special law: leaving Poland for more than 30 days deprives the right to stay under UKR status. Shorter trips do not affect status. The count starts from the day of departure, and you will not receive any notification about loss — the norm works by itself. One exception in the law exists: article 11 paragraph 3 excludes those sent abroad to work or provide services by Polish companies from this rule.
Do Slovakia recognize Polish zaświadczenie and PESEL UKR?+
As a basis for Slovak status — no. Slovak police check your identity and Ukrainian citizenship, not Polish papers. Take a foreign passport: with it, status is granted on the visit day. Polish documents will help for your own chronology — for example, when calculating those 30 days.
Can you return to Polish status if things do not work out in Slovakia?+
Automatically — no. UKR status lost due to protection in another EU country does not restore itself. Whether you can register again in Poland depends on the state of the special law at your return: from March 5, 2026, a separate law on its winding down applies, and conditions for new applications change. If you plan such a rollback — first write to Urząd do Spraw Cudzoziemców and wait for a response, then proceed.
Do you need to surrender the Polish document or write a refusal application?+
Official materials do not contain such a requirement: the right under the special law disappears by the law itself. There is no separate refusal procedure — neither paper nor online — described by the state. If the situation is unusual, for example, you received benefits, ask directly at the gmina that registered you.
Does Slovak status cancel if you travel to Ukraine?+
No. From the Slovak law perspective, travel to any country, including Ukraine, does not cancel temporary asylum. It is better to cross the border with a valid passport and plastic card; if you only have a printed document, first check entry conditions in the country you are going to.
Until what date does temporary protection currently apply?+
Until March 4, 2027 — this date is on both Slovak and Polish documents. On July 30, 2026, the EU Council adopted Implementing Decision 2026/1912 and extended protection until March 4, 2028 (agreed by EU countries on July 15). But the extension applies from March 5, 2027, and Slovakia has not officially announced the new date yet, and national IDs still show 2027. Follow updates of your documents.
